            BY ACCEPTANCE OF SEED ACCOMPANYING OR OPENNING THE PACKAGE OF THE COMPANY USER ACKNOWLEDGE THAT USER HAS READ AND UNDERSTOOD THE FOLLOWING TERMS AND CONDITIONS AND AGREES TO BE BOUND BY TERM AS BELOW.

WARRANTY  AND  LIMITATION OF  LIABILITY

The Company warrants that the seed in this package conforms to company’s standard specifications and labeling. To the extent permissible under applicable law,

         1. Company hereby disclaims: All express or implied warranties, including warranties of merchantability and fitness for a particular purpose. There are no other warranties, including warranties of crop performance or freedom from disease (Even if seed borne).

         2. Weather Conditions: Soil and farming experience and other variants including new and mutated diseases and chemicals can have a major effect in the successful farming of any seeds. Therefore, no warranty against disease, variety or crop performance is therefore given or applied.

Company’s total liability in relation to this seed, however such liability may arise, is  limited in  amount to the purchase price of the seed, Company shall not be liable to buyer for any direct, special incidental or consequential lose or damages regardless of whether such damages are claimed in contract tort (including negligence or breach of statutory duty) , and misrepresentative or otherwise.

         3. Notice of Claim: Notice of any claim in connection with warranty expressly made herein shall be given within a reasonable time after discovery.
Notice given after the point in time in which the company cannot  physically inspect or examine this seed or the resulting crops from this seed  shall be deemed to not be reasonable notice hereunder.

         4. Product & Variety Disclaimer: Weather conditions, soil, and farming experience and other variants including new and mutated diseases and chemicals can have a major effect in the successful farming of any seeds. Therefore, no warranty against disease, variety or crop performance is therefore given or applied. See the Warranty and Limitation of Liability, subheading under the terms and conditions.

         5. Disease resistance of communication no warranty: High/standard resistance (HR): plant varieties that highly restrict the growth and development of the specified pest or pathogen under normal pest or pathogen pressure when compared to susceptible varieties. These plant varieties may, however, exhibit some symptoms or damage under heavy pest or pathogen pressure.
  
Moderate/intermediate resistance (IR): plant varieties that restrict the growth and development of the specified pest or pathogen, but may exhibit a greater range of symptoms or damage compared to high/standard resistant varieties. Moderately/intermediately resistant plant varieties will still show less severe symptoms or damage than susceptible plant varieties when grown under similar environmental conditions and/or pest or pathogen pressure. Performance may depend on local envirnoment conditions.
